What is unclaimed restitution?

Unclaimed restitution is restitution that a defendant has been ordered to pay to a victim of a crime, but the victim can no longer be located or identified.

Effective July 1, 2018, Virginia Victims Fund was tasked with locating victims of crime to whom these funds may be due. If, after more than one (1) year, the funds have gone unclaimed, the Courts of the Commonwealth of Virginia forward the unclaimed restitution to the Virginia Victims Fund by November 1 of each year pursuant to § 19.2-305.1 (I) of the Code of Virginia.
